This is the type of responses you may receive from your Employer or deligated Authority.Â
Annexure D: Example of pro forma letter on the outcome of the Employer ’s investigation.
In a case where further investigation was called on, once the investigation has been completed the letter you must receive will have to be along the lines of this pro forma letter.Â
Annexure E: Head of Department’s Report To Health Risk Manager For Ill-Health Retirement
Annexure E deals with the communication between the Employer and the Health Risk Manager if the Employer deems it fit that the Employee must apply for Ill-Health Retirement based on the documentation forwarded to the Office of the Employer. Only the DDG in the Office can make a final recommendation to the Pension Fund that the mentioned Employee may retire.

Annexure G: Guidelines For Incapacity Assessment
This document is especially important to any Supervisor or Employer Representative. As some disorders not mentioned may fall within the range of being classed a disability and not an actual illness it is imperative that the Supervisor or Employer Representative consults with a labour lawyer to get clarity in this matter.
Two specific disorders for which at present no medical testing or phycological testing, can accurately determine the level of the impairment it is best to look at following the Misconduct or Poor performance route before making decisions on suspensions or compulsory sick leave.Â
Within each one of the practices, the employer may get to enforce a sanction with much more ease if all the facts have accurately presented and the Alterum Pateram rule applied. That sanction could include medical testing or even occupational therapy. However, such a sanction can only be made by adhering to the Disciplinary Process and or the process when a new Employee is still under probation.
