Substantive Issues
This Section of the Code deals with the definition and different types of harassment, sexual harassment and racial or social origin harassment.
No Longer is the Code only limited to Sexual Harassment in the Workplace but will now include all types of harassment and nor only limited to those mentioned in the past.
The Issues at hand starts with understanding the term ‘harassment’ and how it has now been extended to a wider application in as well as outside the work environment, yet with your relationship with other in the world of work.
We will focus on Sexual Harassment and how to look at the factors of harassment, to determine the facts related to the acts of someone having sexually harassed another person.
Next our focus will shift to harassment related to Racial, ethnic and or social origin.
This may not apply directly to a discriminatory act, however can be applied by certain subtle behaviors towards the other person or in this case the employee.
We will end this lesson with other Statutes that may have an impact on harassment. Here we specifically refer to current Acts that to date has covered the matter of unfair discrimination, yet not completely addressing other forms of harassments.
